General terms and conditions of business ( Allgemeine Geschäftsbedingungen AGB )
1. Vertragsschluß, Vertragsabwicklung
Die folgenden Bedingungen regeln das Vertragsverhältnis zwischen der Agentur Maxi & Friends und dem jeweiligen Kunden. Der Kunde nimmt telefonisch oder per eMail Kontakt mit der Agentur auf und richtet an diese eine Anfrage. Dabei sind folgende Angaben erforderlich: Name, Telefonnummer und bei Hotelbesuch Anschrift und Zimmernummer des Hotels, bei Hausbesuch die Anschrift. Im Rahmen der Bearbeitung werden die Einzelheiten der Anfrage geklärt und bei Einigung durch Terminbestätigung kommt ein rechtswirksamer Vertrag über die Buchung der gewünschten Dame zustande.
Unter dem Punkt „Honorare“ sind die derzeit gültigen Preise für die mit der Escort-Lady verbrachte Zeit dargelegt. Die Honorierung erfolgt nicht für bestimmte Handlungen gleich welcher Art. Ebenfalls ist unter diesem Punkt dargelegt, dass Reisekosten individuell vereinbart werden und je nach Entfernung geringe Reisekosten hinzukommen, die nach Aufwand berechnet werden. Am Wohnort der Dame fallen keine Reisekosten an.
Wie unter dem Punkt „Buchung“ erläutert, ist das Honorar der Escort-Lady zu Beginn des Treffens in einem unverschlossenen Briefumschlag auszuhändigen. Rückzahlungen sind nach Beginn des Dates ausgeschlossen.
Eine Anzahlung von 30% zuzüglich Reisekosten erheben wir nur für den Fall der Buchung ab einem Tag oder bei längerer Anreise der Dame. Die Anzahlung kann bei Stornierungen durch den Kunden nach 24 Stunden vor dem vereinbarten Termin leider nicht rückerstattet werden.
Bei einer Stornierung der Buchung durch die Agentur, z.B. wegen Krankheit der Escort-Dame, wird ein alternativer Termin oder eine andere Dame vorgeschlagen. Sollte dies nicht im Interesse des Kunden sein, werden bereits geleistete Anzahlungen umgehend zurückerstattet. Weitergehende Ersatzansprüche sind ausgeschlossen.
2. Diskretion und Datenschutz
Absolute Diskretion und Seriosität sind für unsere Escort-Agentur selbstverständlich. Alle Damen sind vertraglich zur Verschwiegenheit verpflichtet. Ihre persönlichen Daten werden streng vertraulich behandelt. Kunde und Model verpflichten sich außerdem, sich niemals außerhalb der Vertragsdauer direkt zu kontaktieren, sondern jeden Kontakt ausschließlich über unsere Escort-Agentur herzustellen.
3. Widerruf
Sie können als Verbraucher Ihre Vertragserklärung innerhalb von zwei Wochen ohne Angabe von Gründen in Textform (z. B. Brief, Fax, E-Mail) widerrufen. Die Frist beginnt mit Vertragsabschluß. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs. Der Widerruf ist zu richten an: Firma MY-IT Media Service, Sascha Böhme, Unter den Weingärten 58, 63546 Hammersbach, eMail: info @maxi-friends.com. Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit der Absendung Ihrer Widerrufserklärung, für uns mit deren Empfang.Sobald Agentur oder Escort-Lady vor Ende der Widerrufsfrist, in ausdrücklichem Einverständnis mit dem Kunden, die Vertragserfüllung begonnen hat, erlischt das Widerrufsrecht vorzeitig.
4. Schlussbestimmungen
Auf die vorliegenden Allgemeinen Geschäftsbedingungen und auf den jeweils geschlossenen Vertrag ist ausschließlich deutsches Recht anwendbar. Sollten eine oder mehrere Klauseln dieser Geschäftsbedingungen ganz oder teilweise unwirksam sein, so soll hierdurch die Gültigkeit der übrigen Bestimmungen nicht berührt sein.
